The AIGA organization represents the membership of some 19 Tribes and represent 90 percent of the Native American Indians who live on the reservations within the sate of Arizona. This organization was created to help both protect and promote the welfare of Native American Indian Tribes. Their focus has been, and still is, is to help their members strive to be self reliant.

The organization stands by their belief that they are most definitely committed to both maintaining and protecting the Indian sovereign government authority. The IGRA Regulatory Act allows any state to operate Indian gaming on reservations if the state permits such gaming off-reservation.

The IGRA Act was a result of a Supreme Court ruling that basically said that states do not have any leverage over gaming on any United States Tribe reservation.

Prior to this Act, the 1987 U.S. Supreme Court ruling in California v. Cabazon Band of Mission Indians, really meant that states do not have any regulatory authority when it comes to Indian reservation casinos.

The Indian Gaming Regulatory Act of 1988 permitted states and Indian Tribes to be able to regulate Class III Tribal gaming, which is inclusive of games such as blackjack, slot machines, keno and other such related casino style games.

During the early 1990s, there were several Arizona Tribes that had installed slot machines in their casinos even though none of them had Tribal-State Gaming Compacts with the state. At that time, the Arizona governor Symington believed that Native American reservations should not be allowed to have casinos, because at that time, Arizona did not permit any gambling that was considered to be off-reservation.

Tribes contended that Arizona was already permitting gambling by allowing gambling acts such as horse and dog racing, charity bingo games, as well as the state lotteries that were readily available.

The National Indian Gaming Commission issued rules that clarified these rules in 1992, which said that a Tribe must have a gaming Compact with a state before it is allowed to operate slot machines on its land.

Following this ruling, the Arizona Governor called on the United States Attorney in Phoenix, Arizona, to proceed to shut down any and all casinos that had slot machines. It was like something that you would see in a movie. FBI agents raided several Indian gaming casinos and seized their gaming slot machines.

At the Fort McDowell Casino located near Scottsdale, Arizona, many of the Native American Tribal members tried to prevent these agents from removing their slot machines by forming a blockade which resulted in a three week long standoff.

One year later in 1993, the governor signed off on an agreement with the Native American Indian tribes which allowed Tribes to have these gaming slot machines on each of their reservations.

Not included in this Compact agreement were any table games. In 2003, however, the popular game of blackjack was added to the list of table games that were allowed.

The State Governments of Nagaland, Sikkim, Goa, Maharashtra, Kerala and Bhutan are openly defying the Directives and legislations enacted by the Government of India regarding The Lotteries (Regulation) Act, 1998 and Lotteries Regulation Rules 2010.

In a brazen display of arrogance these governments are carrying on with Double/ triple digit lotteries, which was banned by the Central Government in with effect from April 2010 due to the vulnerability of gullible poor people of India.

In furtherance to the said Act of 1998, the Government of India, made and published The Lotteries (Regulation) Rules 2010 effective from 1.4.2010 whereby the State Governments are prohibited to offer a prize on a lottery ticket or in an online lottery, on the basis of single, double or triple digit in any form or combination, as laid down in Rule 3 (14).

The Act also clearly mentions that no prize can be offered on any preannounced number. So how are the results of the lotteries pertaining to these states and Bhutan are declared by adding Suffix or a prefix 0-9/ 00-99 ? it is a clear violation of the act in the section 4(a), where First or First two numbers are fixed before the draw and results are taken out on 2 and 3 digits.
It is known that poor labor class is more prone to play on those tickets wherein prizes are based on single, double or triple digits. It is well known that a public member would definitely like to invent new circumventing methods to officially flout or violate the rules and regulations but in this unique case, State Government is adopting dubious methods to defy Central Legislation.

It is alleged by the knowledgeable circle that there is a nexus of officials of state government, politicians and a certain class of businessmen @ mafia who are involved in this multi-crore scam. Even after the letter written by the Home department to Government of Sikkim and Goa indicating violation of the rules, these states are sitting tight on the said issue without taking any action to stop these illegal lotteries. Only the state Government of Kerala has raised this question earlier to the Home department but surprisingly we realized that they them self are adding a Prefix A-E before their results.

When will the Government wake up to the issue is a million dollar question. Is any one listening please?

 

 

Indian casino gaming as we know it all began with the Seminole tribe of Florida. It wasn’t very long ago at all.

The Seminoles first opened a high-stakes bingo hall on their reservation in 1979. And just like anything in the United States, the government in Florida quickly moved in, attempting to close down the operation.

However, the courts interceded and stopped the attempts by Florida to overthrow the bingo hall. But despite the early victories in court by the Seminole tribe, the legality of Indian casino gaming was still very much in doubt.

There have been a few landmark events which sparked a flame of revolution in the Indian casino gaming venture. One important case took place in California.

The case of California versus Cabazon Band of Mission Indians took place in 1987. It was ruled by the Supreme Court that Indian tribal governments could operate gaming institutions in their sovereignty, without the interference of outside state regulations. This of course entailed that gaming operations not be directly prohibited in that particular state. At the present date, only two states in the USA strictly prohibit gambling: Utah and Hawaii.

After the Supreme Court gave definitive legal rights to Indians, it was time for congress to act. Indian casino gaming was to be taking very seriously. Some say it was a way to partially make up for all the wrongs of our predecessors in this country. The way the Indians were treated was nothing less than appalling; the least the U.S. could do was allow them to operate gaming halls in their own country. In 1988, Congress passed the Indian Gaming Regulatory Act (IGRA) to set the rules and regulations for Indian casino gaming.

For starters, the IGRA separated Indian gaming into three separate classes. Class I gaming is defined strictly as traditional gaming, or social gaming which offers minimal prizes. There is no regulation at all for Class I gaming outside of the respective tribal governments. This leaves Indians to operate any sort of Class I gaming without any regulation whatsoever.

Class II gaming includes games of chance. Any game that isn’t based on a skill-set is deemed a game of chance. For example, bingo and other similar games such as cards are included if they are played solely against other players and not against the house. However, slot machines are specifically prohibited from Class II gaming. Class II gaming is allowed on Indian reservations for as long as such activities are already permitted by the individual state.

The third class, Class III gaming, involves any games that are not included in classes I or II. This does include the aforementioned slot machines, and also blackjack, roulette, craps, etc. Indian tribal governments must first work out a compact with an individual state in order for a Class III gaming operation to be instituted.
